Major Decision by British Columbia’s Supreme Court Impacts Canadian Healthcare
A landmark decision in a case spotlighting Canada’s on-going healthcare dilemma was handed down this week. It will have long term impact on both Canadian public healthcare systems, and on decisions Canadians are making to obtain private health insurance which open options for care in the U.S. and worldwide.
After a legal battle spanning several years, the B.C. Supreme Court dismissed a case brought by Dr. Brian Day, a private healthcare advocate. Dr. Day claimed Canada’s system denies patients the right to timely care. He believes there should be a constitutional right to pay for private care when wait time in the public system is too long.
Though dismissed, presiding Justice John Steeves commented, “Some of these patients will experience prolonged and exacerbation of pain and diminished functionality, as well as increased risk of not gaining full benefit from surgery.” The Canadian Medical Association also commented that “healthcare funding has not kept pace with efforts to improve funding for an aging population.”
